Gun license law in India
India already had one of the strictest gun laws in the world, a group of British colonial rule intended to destroy its subjects. The law of India allows citizens to carry and carry guns, but it is not a rightful possession in the constitution. Obtaining a gun license in India is a difficult task which can take years.
The latest reorganization of the rules (2016) has been the biggest paradigm since the inception of the Arms Act. Under the new rules, prospective gun owners will have to show, among other things
- Pre-requisite training in gun handling– Everyone applying for an arms license or rifle club or association or firing range or staff employed by such club or a manufacturer or dealer will be required to complete an arms and ammunition safety training course . Training courses include basic weapons and ammunition safety practices, including safe handling and carry procedures, firing techniques and procedures, care of weapons and ammunition and their safe storage and transportation.
- Holders Mandatory – People can now carry firearms only in ‘holders’.
- Gun Lockers – Licensed individuals must secure their firearm in the event of a “gunpoint” in the gun locker at home.
- Gun Free Zone – In addition to these provisions, the government has set up schools across the country, called gun-free zones. Normal citizens with reasonable apprehension can apply to convert their area into a ‘gun-free zone’. The rule states that the owner or occupier of a property may have submitted an application to declare the premises as a firefighter free zone, ‘giving reasons and evidencing the ability to maintain the ban.
- One Anticipated Threat – In order to obtain a license one usually has to show a copy of the FIR to prove any threat to life or property. Now the “imminent” threat has been replaced by the “anticipated” threat because it was “difficult to prove” for former applicants. Practically the anticipated danger must be a threat to speak that can be foreseen and proven.
- Liberalization in Extremism Affected Areas – The rules state that the designated authority will consider giving restricted or permissible weapons to those who are serious about their lives due to being resident of a geographic area or people living in those areas, terrorists or extremists and Face the anticipated danger. Most active, and who are the main target in the eyes of terrorists
- Taser guns are now allowed – for the first time, however, the government has allowed citizens to license electronic inefficient devices such as Taser guns – a move that could boost women’s safety.
